Depending on your circumstances, eligible Class Members may receive a Base Payment of up to $9,000 for Youth Inmates, $6,000 for SMI Inmates, or $3,000 for Prolonged Inmates . The maximum total compensation available is $100,000 for Youth Inmates, $91,000 for SMI Inmates, and $88,000 for Prolonged Inmates .

Certain placements are presumptively statute-barred. This means you can only make a claim in relation to those placements through the Statute-Barred Claims Process. This applies if:

  • your only adult placements in Segregation ended before September 12, 2016 and you did not suffer from a Serious Mental Illness; or you turned 18 on or before September 12, 2012 and your youth placements in Segregation ended before September 12, 2012.

  • you turned 18 on or before September 12, 2012 and your youth placements in Segregation ended before September 12, 2012.

If this applies to you, you should fill out a Claim Form and indicate that you wish to make a Statute-Barred Claim. You must submit a fully completed Claim Form to the Administrator by August 24, 2027, or else you will not be eligible for any money.
