Current Status

Claims are open. The completed claim form must be received by the court-appointed claims administrator, MNP Ltd., by 5:00 p.m. Pacific time on October 30, 2026. The Supreme Court of British Columbia has signed an order approving the settlement following an approval hearing scheduled for June 12, 2026. No payment date had been announced as of October 3, 2026.

What Changed Recently?

MNP Ltd. has published a court-approved notice of the claims deadline, opening the claims process in Heimburger v BigSteelBox Corporation, a class action in the Supreme Court of British Columbia over property stored at BigSteelBox’s container yard on North Parallel Road in Abbotsford during the November–December 2021 floods.

The plaintiffs alleged that BigSteelBox was liable for water damage to property customers kept in its storage containers. BigSteelBox denies all of the allegations and any liability, and the settlement notice states that liability and damages have not been proven. On March 20, 2026, Justice Caldwell certified the case as a class proceeding for settlement purposes only, appointed Zacharias McCann LLP as class counsel and MNP Ltd. as claims administrator, and set the settlement approval hearing for June 12, 2026. The court has since signed an order approving the settlement, and MNP is now accepting claims.

Who Qualifies?

The class covers all individuals, legal persons, businesses and estates whose property was stored in containers at BigSteelBox’s facility at 37400 North Parallel Road in Abbotsford, British Columbia, at any point between November 14, 2021 and December 17, 2021, and whose property was damaged by flood water entering a storage container.

Class members were included automatically unless they opted out. The opt-out deadline was May 7, 2026, and anyone who opted out cannot make a claim. The claim form asks claimants to say whether the stored goods were used mainly for personal or household purposes or mainly for business purposes. A claimant can qualify as a residential customer or a business customer, but not both.

How Much Can You Get?

BigSteelBox agreed to pay an all-inclusive $1,000,000 CAD. Because the amount is all-inclusive, the court-approved legal fees and disbursements of class counsel, any honorarium approved for the representative plaintiffs, and notice costs come out of it before claimants are paid.

There is no fixed payment per claimant. MNP Ltd. and its designated property value appraiser use each claimant’s Schedule of Loss and supporting documents to estimate the actual cash value of the damaged property, meaning its depreciated value rather than its replacement cost, and MNP then decides whether the claimant is entitled to a share of the settlement funds and how much. The claim form says MNP’s decision is final and binding, and that filing a claim does not guarantee a payment. Because the total of all approved claims is not known, no estimate of individual payments is available.

What Proof or Notice ID Is Required?

Proof is required. No notice ID or claim number is needed, but the claim form lists two mandatory attachments: a copy of a valid government-issued photo ID, and a completed Schedule of Loss. The Schedule of Loss is an item-by-item list of the damaged property, asking for each item’s type, a full description including make, model and serial number, the purchase date, store and price, an estimate to repair or replace it, whether it was destroyed or repairable, and the dollar value claimed. MNP may reject a Schedule of Loss that does not give the appraiser enough information to value the claim.
